1. Overview & Acceptance of Terms
Welcome to Edenary.com (“Edenary,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website, services, and purchase of products offered through Edenary.com.
By accessing our store, browsing our catalog, or making a purchase, you agree to be bound by these Terms, including our Privacy Policy and Shipping & Returns Policy. If you do not agree to all of these Terms, you may not access or use our website or purchase our products.
2. Store Model, Inventory & “The Vault” Drops
30-Day Drop Cycle: Edenary operates on a limited-release 30-day “Vault” drop model. Products and designs featured in a monthly release are available for purchase only during that calendar month, unless otherwise specified.
Archiving Policy: At midnight on the final day of each monthly drop, featured designs enter The Vault and are archived. Archived items are no longer available for purchase, and we do not guarantee restocks, backorders, or post-vault production runs.
Small-Batch Variations: Due to specialized production methods (including vintage snow washing, garment dyeing, and custom printing techniques), minor variations in dye tone, fabric wash, print placement, or finish are normal and expected. These variations contribute to the uniqueness of each garment and are not considered manufacturing defects.
3. Orders, Pricing, and Payments
Order Acceptance: Receipts of an electronic order confirmation do not signify our acceptance of your order. We reserve the right at any time after receipt of your order to accept, decline, or limit your order for any reason.
Pricing & Currency: All prices displayed on Edenary.com are listed in U.S. Dollars (USD). We reserve the right to modify pricing at any time without prior notice.
Payment Processing: Payment must be made in full at the time of purchase via our authorized third-party payment gateways (e.g., Shopify Payments, credit/debit cards, Apple Pay). By providing payment details, you represent that you are authorized to use the designated payment method.
Errors & Omissions: In the event a product is listed at an incorrect price due to a typographical error or technical glitch, we reserve the right to cancel or refuse any orders placed for items listed at the incorrect price.
4. Shipping, Fulfillment, and Delivery
Fulfillment: Orders are processed and prepared for shipment from our Houston, Texas facility or print partner network in accordance with standard fulfillment windows.
Shipping Carriers: Delivery times provided at checkout are estimates supplied by third-party shipping carriers (e.g., USPS, UPS, FedEx) and are not guaranteed. Edenary is not liable for carrier delays, weather disruptions, or incorrect shipping addresses provided by the customer at checkout.
Risk of Loss: Risk of loss and title for all products pass to you upon our delivery of the package to the shipping carrier.
5. Returns, Exchanges, and Refunds
Limited-Edition Exchange Policy: Because items are produced in small-batch 30-day drops, size or color exchanges are strictly subject to remaining inventory availability during the active drop window. Once a drop enters The Vault, physical exchanges for identical items may not be possible.
Standard Return Window: Unworn, unwashed, and undamaged items in original condition may be returned within 14 days of delivery for store credit or refund, minus shipping costs, unless otherwise stated at purchase.
Defective or Damaged Goods: If you receive an item that is misprinted, damaged, or defective, you must contact us at support@edenary.com within 7 days of delivery with photos of the issue. Confirmed defective items will be replaced free of charge or fully refunded.
6. Intellectual Property Rights
All content included on Edenary.com—including text, graphic designs, garment graphics, typography, manifestos, logos, product descriptions, photography, videos, and website copy—is the exclusive property of Edenary and its parent entity/collectives, protected by United States and international copyright, trademark, and intellectual property laws.
You may not reproduce, distribute, modify, display, perform, publish, license, create derivative works from, frame, or sell any content or artwork obtained from Edenary.com without prior written consent.
7. User Conduct & Prohibited Uses
You agree not to use Edenary.com for any unlawful purpose or in any way that could damage, disable, or impair the site. Prohibited actions include, but are not limited to:
Re-selling or commercializing Edenary products or graphics without express authorization.
Scraping, data mining, or using automated systems to extract data from our store.
Submitting false, misleading, or fraudulent payment or contact information.
Transmitting viruses, malware, or destructive code.
8. Disclaimer of Warranties & Limitation of Liability
“As-Is” Basis: Edenary.com and all products, materials, and services made available to you through the store are provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied.
Limitation of Liability: In no event shall Edenary, its directors, officers, employees, partners, or suppliers be liable for any indirect, incidental, punitive, or consequential damages arising out of your use of the website or purchase of any product. Our total liability for any claim shall not exceed the amount paid by you for the specific product or service in dispute.
9. Governing Law & Dispute Resolution
These Terms and your use of Edenary.com shall be governed by and construed in accordance with the laws of the State of Texas, United States, without giving effect to any principles of conflicts of law. Any legal suit, action, or proceeding arising out of these Terms or your purchases shall be instituted exclusively in the federal or state courts located in Harris County, Texas.
10. Severability & Modifications
Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.
Changes to Terms: We reserve the right to update, modify, or replace any part of these Terms at our sole discretion. It is your responsibility to check this page periodically for changes. Your continued use of the site following the posting of modifications constitutes acceptance of those changes.
